Amendment Proposal by Fleet #120: National Championship Qualifying Series Right to Appeal

Change Article XIII 2. National Race Committee fourth paragraph to read: Competitors in the National Championship shall not be denied the right of appeal unless the National Race Committee and the Organizing Authority together have obtained approval from US Sailing to deny the right to appeal protest committee decisions affecting the races in the qualifying series (see the US Sailing prescription to racing rule 70.5(a)).

CURRENT Article XIII 2. National Race Committee fourth paragraph: Competitors shall not be denied the right of appeal, according to USSA procedure. The results shall be accordingly changed, except that in the event a competitor appeals an unfavorable protest, and the race involves a qualifying race for the Championship Division, and the competitor is placed in the President’s Division, the results of the regatta shall not be changed.

INTENT:

Invoking such a waiver would prevent the potentially inequitable changes in scoring and fleet qualification if an appeal decision later reversed or imposed an unfavorable decision against a competitor or boat in the qualifying series.
